Terms of Service

1. Acceptance of Terms

By accessing or using TCGCollect (tcgcollect.app), you agree to be bound by these Terms of Service (“Terms”). These Terms are a legally binding agreement between you and TCGCollect. If you do not agree to these Terms in their entirety, you may not access or use the service. We may amend these Terms at any time by posting a revised version on the site. Your continued use of the service after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Service

TCGCollect is a web application that allows users to track and organize their Pokémon TCG card collection. Features include collection tracking, set browsing, dynamic lists, and card pricing information.

3. Children Under 13

The service is not directed to children under 13 years of age. By using the service, you confirm that you are at least 13 years old. If you are between 13 and 18, you may only use the service with the permission of a parent or legal guardian. We do not knowingly collect personal information from children under 13. If we learn that such information has been collected, we will take steps to delete it promptly.

4. User Accounts

You may sign in using Google or Discord OAuth. You are solely responsible for maintaining the confidentiality and security of your account. You agree not to share your account credentials or transfer your account to any other person. All activity that occurs under your account is presumed to be authorized by you. TCGCollect is not responsible for any loss resulting from unauthorized access to your account. You may delete your account at any time by contacting us at hello@tcgcollect.app.

5. Electronic Communications

By using the service, you consent to receive electronic communications from us, including notices, updates, and other information related to your account and the service. You agree that all communications we provide to you electronically satisfy any legal requirement that such communications be in writing.

6. Payment Terms

TCGCollect may offer paid features or subscriptions in the future. Payments will be processed through Stripe, a third-party payment processor. By making a purchase, you agree to Stripe's Services Agreement. All payments are non-refundable unless otherwise stated. If your payment is declined, we reserve the right to contact you directly to seek resolution.

7. Prohibited Conduct

You agree not to: use the service for any unlawful purpose; attempt to gain unauthorized access to any part of the service or its systems; scrape, crawl, or use automated means to access or collect data from the service; reverse engineer, decompile, or disassemble any part of the service; impersonate any person or entity or misrepresent your affiliation with any person or entity; interfere with or disrupt the service or servers connected to the service; harvest or collect personal information about other users without their consent; or attempt to circumvent any security or access control measures.

8. Intellectual Property

TCGCollect is not produced, endorsed, supported, or affiliated with Nintendo, Game Freak, Niantic, Wizards of the Coast, or The Pokémon Company. All Pokémon names, images, and related content are trademarks of their respective owners. All other content on the service, including the look, feel, design, and code, is the property of TCGCollect and may not be reproduced or used without express written permission.

9. Disclaimer of Warranties

The service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any defects will be corrected.

10. Limitation of Liability

To the fullest extent permitted by law, TCGCollect shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service, even if we have been advised of the possibility of such damages.

11. Indemnification

You agree to indemnify, defend, and hold harmless TCGCollect and its operators from and against any claims, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from your use of the service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We reserve the right to suspend or terminate your access to the service at any time, without notice, for any reason including violation of these Terms. Upon termination, your right to use the service will immediately cease.

13. International Users

The service is operated from the United States. If you access the service from outside the United States, you are responsible for compliance with all applicable local laws and regulations.

14. Dispute Resolution

Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration on an individual basis. You waive any right to participate in a class action lawsuit or class-wide arbitration. These Terms are governed by the laws of the United States, without regard to conflict of law principles.

15. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severed from these Terms and shall not affect the validity and enforceability of the remaining provisions.

16. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by updating the date at the top of this page and, where appropriate, by emailing the address associated with your account. Continued use of the service after changes are posted constitutes your acceptance of the updated Terms.
